On May 21, 2019, the Office of the United States Trade Representative (USTR) announced its intention to implement a product exclusion process related to the China-origin products valued at $200 billion (the Third Tranche) on which U.S. import duties were recently increased from 10 to 25 percent. The first two tranches of China-origin products on which USTR imposed duties -- valued at $34 billion and $16 billion, respectively -- already were eligible for exclusion from the 25 percent. USTR anticipates the window for filing new exclusion requests on the Third Tranche of products will open June 30, 2019, with support or opposition responses due 14 days after the date the USTR posts the request, and with replies to the response due seven days after the USTR posts the response. To assist parties in filing exclusion requests, responses and replies, and assist USTR in analyzing them, the USTR will require respondents to use a required exclusion request/response/reply form.
