Tax credit financing

Our attorneys have extensive experience representing financial institutions in tax credit financings throughout the country, including lender representation in hundreds of construction projects supported by one or more of the following: low income housing tax credits, ARRA Tax Credit Exchange Funds, ARRA Tax Credit Assistance Program Funds, historic tax credits, new markets tax credits, lost development rights, tax increment financing, USDA Rural Housing funds and/or HUD HOPE VI funds. Our experience enables us to anticipate potential structuring issues and advise lenders in these complex transactions involving multiple layers of financing, grants and equity.

Representative matters include:

  • Represented multiple national lenders in over 100 low income housing construction projects supported by low income housing tax credits, many of which were also supported by Historic Tax Credits, TCE funds and/or TCAP funds
  • Represented lender in a $20+ million hotel construction project supported by New Markets Tax Credits, Federal Historic Tax Credits and State Historic Tax Credits
  • Represented developer in $45+ million mixed-use project supported by New Markets Tax Credits and 11 sources of financing
