Appropriation and eminent domain
The right of government entities to appropriate private property through an appropriation, condemnation or eminent domain lawsuit attempts to delicately balance the fundamental rights of private property against the public’s need to use and develop real property for the public good. Porter Wright’s attorneys are highly experienced in the law of eminent domain and uniquely situated to provide effective counsel during an appropriation action because they have regularly represented both public agencies and companies in the appropriation of real property and also private property owners whose property is being appropriated for public use. In either situation, our experience and capability allow us to provide effective counsel to assure that private property rights are respected and properly compensated, but that the public’s right to appropriate property for the public good is preserved.
