Real estate financing
Loan financing
Our attorneys represent lenders, lender groups, administrative and collateral agents, and borrowers in connection with real estate financing arrangements of all types. We advise on structure, and negotiate and document loan commitments, credit facilities, loan participations, subordination agreements and intercreditor agreements arrangements. Our background in real estate and financing of real estate loans made to a variety of industries and secured by many types of collateral enables us to identify potential loan issues quickly and resolve them at an early stage.
Mortgages and sale/leasebacks
Our attorneys represent developers, borrowers, banks, insurance companies and conduit lenders in a wide variety of traditional financing transactions, including construction and permanent loans, multi-property and multi-state transactions, as well as in sale/leaseback transactions. Whatever the financing need, our attorneys help clients to develop tailored solutions appropriate for their opportunity.
Securitized lending
In addition to representing lenders and borrowers in traditional real estate financings, our attorneys represent regional and national lenders who make securitized loans in the commercial mortgage backed securities (CMBS) market. This rapidly expanding source of funds provides unique opportunities for our borrowing clients to leverage their real estate portfolios.
Recent real estate financing representations include:
- Represented a lender in a multi-million dollar construction project including office, hotel and retail space
- Represented a lender in a major construction loan restructure for a multi-million dollar mixed-use office, apartment and lifestyle retail shopping center
