Insurance intermediary representation
The Porter Wright team has decades of experience counseling and representing the entire spectrum of insurance intermediaries, including retail insurance agencies, wholesale insurance agencies and brokers, managing general agencies, third-party administrators, and insurers. This includes pre-dispute counseling, and representation in litigation, arbitration and regulatory matters. Our team understands the highly-complex regulatory and contractual environment in which insurance intermediaries serve their clients. We have experience representing insurance professionals in contractual disputes concerning underwriting guideline compliance and indemnity disputes under agency management agreements. We also routinely represent insurance intermediaries in restrictive covenant and trade secret disputes and litigation.
We have provided pre-suit counseling and litigation/trial representation of insurance and legal professionals. This representation is on an assigned insurer basis or on a self-insured basis. Our in-depth knowledge of the insurance and legal professions enables us to resolve professional malpractice claims and other disputes involving breach of contract, breach of fiduciary duty, errors and omissions, negligence and fraud.
In addition, we routinely assist parties in third-party insurance coverage disputes, including a range of coverage, litigation matters and “bad faith” claims handling. Our team members have served as coverage and advisory counsel across the country and abroad, and we have litigated declaratory judgement actions in state and federal courts.
