Ned Searby obtains significant client victory in federal healthcare fraud case in Houston

White collar attorney Ned Searby secured victory for his clients on Aug. 15, 2023, in an alleged $32 million health care fraud case. In the matter, Searby had been engaged as additional counsel for certain legal challenges to the prosecution, Case No. 4:21-CR-62 (Southern District of Texas). Searby, who also teaches criminal procedure at Case Western Law School, filed an omnibus motion to suppress seized evidence pursuant to a series of federal search warrants in the case. Following extensive briefing and oral argument, the Court set the motion for an evidentiary hearing over the Government’s objection, and the Government then conceded suppression to avoid the hearing. The Court then entered an Order suppressing the use of any evidence obtained from nine federal search warrants – a victory for Searby’s clients.
