Affirmative Action

Jamie represents large and small employers in all stages of compliance with  state and federal affirmative action obligations. Her experience ranges from preparing an affirmative action plan for a contractor or subcontractor, or advising on an existing affirmative action plan to defending a contractor or subcontractor during a compliance audit by the Office of Federal Contract Compliance Programs (OFCCP).

This representation includes:

  • Providing general advice on developing affirmative action plans and compliance with federal and/or state affirmative action laws
  • Evaluating whether an employer is a contractor or subcontractor
  • Reviewing employment processes (recruitment, outreach, application flow, hiring, testing, promotion and termination)
  • Reviewing compensation practices
  • Training human resources personnel and hiring managers on compliance and record-keeping requirements
  • Preparing an affirmative action plan and supporting documentation, or reviewing an existing plan
  • Defending contractors in OFCCP audits
  • Negotiating conciliation agreements
