Pressley quoted in Business First wage-and-hour article

Fred Pressley, chair of Porter Wright's Labor and Employment Department, recently was quoted in the Columbus Business First article, "Wage-and-hour suits rising: 13% growth pace a product of lower barriers, leaner companies" on July 12, 2013.

One reason is that the courts have made it easier for employees to file collective actions, said Fred Pressley, chairman of Porter Wright Morris & Arthur LLP’s labor and employment department. Collective action is a bit different than a class action. Both have to be certified by the court to move forward, but a class action has to pass tougher scrutiny, Pressley said. And while workers have to opt into a collective action, they only have to be similarly situated, not identically situated as in a class action.

“We are seeing more of those cases in Columbus than we had in the past,” Pressley said. “The reality is there are very few employers who do not have some type of wage-hour violation going on.”
