Provided counsel to various Class I railroads in numerous FELA and grade crossing litigation matters including trial of such matters.
Obtained summary judgment in various grade crossing cases based on a variety of grounds including federal preemption and reasonable reliance on PUCO crossing inspection results.
Represented railroad clients in a variety of occupational claims (hearing loss, carpal tunnel syndrome, respiratory claims) in which we have successfully obtained judgment on procedural grounds such as the statute of limitations.
Obtained a defense verdict for a railroad in a FELA, carpal tunnel syndrome case brought by a conductor on the railroad.
Represented a client in a FELA case in federal district court involving claims of work-related carpal tunnel syndrome in which the court granted our Daubert motion striking plaintiff's expert testimony and, in turn, granted summary judgment.
Provided counsel to a moving company in a wrongful death action where a motion to dismiss at the trial level and subsequent appeals were won.
Represented a client in a tanker truck rollover case in which it was alleged that the tanker truck, which was carrying chemicals, rolled over due to the "slosh effect" caused by improper loading.
Represented a trucking company in the recovery of hijacked property.
Served as public finance counsel for over $1 billion worth of infrastructure and transportation funding deals for GARVEE Bonds, Ohio Infrastructure Bonds, 629 Roadwork Account Grants, Tax Increment Financing, Ohio Job Ready Site Grants, Clean Ohio Revitalization Fund and other state and local government finance tools on behalf of the Ohio Department of Development, local governments and private sector clients.
Provided representation before CBP in proceedings involving trucks and trailers seized because of contraband.
