White Collar Crime & Government Enforcement
More than ever before, the government is using criminal, civil and administrative enforcement tools to achieve compliance, alter conduct and remedy alleged violations. Porter Wright represents businesses and individuals whose operations and activities are placed under government scrutiny or are the subject of governmental enforcement actions. Our services include:
During the past two decades, governments at every level augmented their civil and criminal enforcement tools with new statutes and complex regulations while simultaneously increasing funding of enforcement efforts. This government strategy brings into play a broad array of enforcement and licensing penalties. In this environment, businesses and individuals not only face possible criminal fines and punishments under federal, and certain state, sentencing guidelines, but must also deal with the possibility of severe -- and sometimes catastrophic -- civil fines, forfeitures, suspension and debarment from government programs and contracting, SEC and other government and private agency enforcement actions and license revocations. Additionally, businesses must respond to private, class action lawsuits, and/or “whistleblower” qui tam actions, which may either precede or quickly follow a government investigation. Even if the government concludes there was no wrongdoing, these private actions can have a crippling effect.

Because many investigations and prosecutions concern alleged violations of substantive administrative statutes and regulations, effective representation requires a thorough understanding of not just the relevant laws, but also industry practices and norms. Porter Wright attorneys, with knowledge of various substantive legal areas including, for example, antitrust, health law, financial institutions regulation, securities, government contracts, environmental law, energy, business, customs and international trade and tax, can respond to a multitude of areas that may come under scrutiny. Since our client is the ultimate expert concerning its business or individual activity, our client is an integral member of our team. Our fully integrated approach enhances our ability to educate the government about our client, our client’s business and industry practices and customs -- factors that can greatly influence the outcome of an investigation.
