Jodka quoted in Law360 article about the risks surrounding firing employees due to their Facebook posts

Sara Jodka, an attorney in Porter Wright's Labor and Employment Department, was recently interviewed for and quoted in the article, "5 Questions To Ask Before Axing Workers For Facebook Posts," printed April 29, 2013, at Law360.com. The article discusses why employers should first take a step back and fully assess the situation before they jump too quickly and take disciplinary action when employees make disparaging remarks on Facebook.

"'The first thing an employer has to do is take step back,' said Sara Jodka of Porter Wright Morris & Arthur LLP. 'Just because the employer is upset by the post and upset that the employee has gone to social media, they need to stop and realize there might be protected conduct, and they need to take another step and determine if the conduct is protected.'

...'In the harassment and discrimination context, an employer needs to think about whether or not posts on social media would trigger ... an employer obligation to engage in a thorough investigation,' Jodka said. 'Employers must take action to stop harassment.'"
