EmployerLawReport Blog:  Ms. Swinerton represents employers in the areas of employment litigation and employee relations counseling. In the employment litigation arena, she defends employers against discrimination and retaliation claims, wage-and-hour claims, tort claims, and claims of wrongful discharge in violation of public policy. Ms. Swinerton also advocates on behalf of clients seeking to enforce the terms of non-competition agreements and works to protect vital employer interests in temporary restraining order and preliminary injunction proceedings. Recognizing the prominence of electronic discovery issues in employment litigation, Ms. Swinerton advises litigation clients as to appropriate document retention policies, implementation of litigation holds, and document production and review strategies. In addition, Ms. Swinerton has experience representing clients that face class action claims, including the management and execution of class action discovery strategies.
Employers turn to Ms. Swinerton for counseling and advice regarding employee issues and concerns. She routinely reviews and revises employment handbook language and policies and can advise employers with multiple locations as to location-specific employment law obligations. Ms. Swinerton has also devoted significant attention to the issue of employee drug testing and is adept at developing and implementing lawful drug testing policies and procedures.
Furthermore, Ms. Swinerton represents employers who require assistance with unemployment compensation proceedings. Whether employers seek to challenge the eligibility of one employee or address larger issues in the unemployment compensation framework, Ms. Swinerton helps employers navigate this area of employment regulation.
