Phil Calabrese adds insights to article in ABA/BNA Lawyers' Manual on Professional Conduct

Phil Calabrese was quoted in an article in ABA/BNA Lawyers' Manual on Professional Conduct on May 6, 2015. The article, "Split Decision in Ohio Turns Away Speedy Appeal of Adverse Privilege Ruling," explores a recent ruling by the Ohio Supreme Court that it lacked jurisdiction to hear an appeal (Smith v. Chen, 2015 BL 112556, Ohio, No. 2013-2008, 4/21/15) over discovery of a surveillance video in a medical malpractice case. Calabrese said the Supreme Court's 4-3 decision can be seen as a "highly formalistic ruling" that turned on the failure to satisfy a requirement in Ohio's interlocutory appeal statute that did not fundamentally change Ohio law for appealing privilege rulings. Calabrese is a partner in the firm's Litigation Department and co-author of "Life After Mohawk: Protecting Privilege in Ohio,” Ohio Law., November/December 2011 at 22-25.
